Dick Clark and his law firm,   Rothgerber Johnson & Lyons, LLP,  have served as legal counsel to CAR since 1990.   Dick regularly advises real estate brokers,  homebuilders,  construction companies, developers and investors on almost every legal issue they confront including preventing liability,  drafting documents,  structuring ownership,  intellectual property, licensing,  policies and procedures,  financing,  non-compete agreements,  RESPA compliance including affiliated business arrangements, broker training,  employment issues,  government relations,  civil litigation and regulatory proceedings.

In August, 2007, Marcia Waters was appointed as the Director of Investigations and Compliance for the Colorado Division of Real Estate.  Ms. Waters oversees the five programs within the Division of Real Estate.  These include the Real Estate Broker Program, the Appraiser Program, the Mortgage Loan Originator Program, the Conservation Easement Program and the Expedited Settlement Program.  The Division of Real Estate regulates approximately 64,000 real estate professionals conducting business in Colorado.

Ms. Waters started with the Division as a criminal investigator for the Real Estate Broker Program.  Prior to assuming the role of the Investigations and Compliance Director, Ms. Waters served as the chief investigator for the Real Estate Broker Program, and was responsible for a staff of nine investigators.  Prior to working for the Colorado Division of Real Estate, Ms. Waters was a police officer on the Lafayette Police Department for approximately eight years, four and half of which she was a detective for the general crimes and family crimes units.  Ms. Waters has also investigated welfare fraud for the Adams County Department of Social Services, and she has also worked as a Bond Commissioner at the Boulder County Jail.  She gained valuable experience in the real estate industry as a real estate broker serving the Boulder County area.

Ms. Waters is a native of beautiful Colorado.  She received her B.A. in Sociology with a concentration in Criminology from the University of Colorado in Boulder.  Her goal at the Division of Real Estate is to protect the Colorado consumer through fair enforcement and responsible regulation of real estate professionals.
